You agree to:
All user-generated content (photos, bios, messages) must comply with our community guidelines. Content that is sexually explicit, promotes violence, or contains hate speech will be removed. Repeated violations result in account suspension or termination.
We take user safety seriously. You can report any user or content that violates these terms. We review reports promptly and take appropriate action. However, we cannot guarantee the identity or behavior of other users.
Dork Date is provided “as is” without warranties of any kind. We are not liable for any damages arising from your use of the platform, interactions with other users, or reliance on any content. Use the platform at your own risk and exercise caution when meeting people offline.
We reserve the right to suspend or terminate accounts that violate these terms, at our sole discretion. You may delete your account at any time through your profile settings.
These Terms of Service and any disputes arising out of or related to them or the use of the platform shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding relating to these terms shall be brought exclusively in the state or federal courts located in St. Joseph County, Indiana, and you consent to the personal jurisdiction of such courts.
Informal Resolution. Before filing any formal dispute, you agree to first contact us at contact@dorkdate.net and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration. If we cannot resolve the dispute informally, you and Dork Date agree to resolve any claims relating to these Terms or the platform through final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will take place in St. Joseph County, Indiana, or at another mutually agreed location. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.
Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you waive any right to a jury trial.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to contact@dorkdate.net within 30 days of creating your account. The notice must include your name, email address associated with your account, and a clear statement that you wish to opt out of binding arbitration.
Exceptions. Either party may bring claims in small claims court if eligible. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for intellectual property infringement or unauthorized access to the platform.
We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the revised terms.
